شروط استخدام تطبيق زرياب

1. من نحن وقبول الشروط
يدير Madian Bros تطبيق زرياب (Zeryapp) في جمهورية مصر العربية. عند أول تشغيل يعرض التطبيق هذه الشروط وسياسة خصوصية التطبيق، وبضغطك «أوافق» فإنك تقبلهما. إذا لم توافق عليهما فيُرجى عدم استخدام التطبيق وحذفه. لموقع zeryapp.com شروط مستقلة في صفحة شروط استخدام الموقع.
2. الخدمة
يقدّم التطبيق مجاناً نوتات موسيقية وتابات جيتار ومصادر لتعلم الموسيقى. قد نضيف محتوى أو نعدّله أو نحذفه، وقد نغيّر التطبيق أو نوقفه مؤقتاً أو نهائياً في أي وقت، دون إشعار مسبق ودون أي التزام تجاهك. قد نطلب منك تحديث التطبيق لمتابعة استخدامه.
3. ترخيص استخدام التطبيق
نمنحك ترخيصاً شخصياً مجانياً وغير حصري وقابلاً للإلغاء لاستخدام التطبيق على أجهزتك. التطبيق مرخّص لك وليس مباعاً. لا يجوز لك نسخ التطبيق أو تعديله أو فك شفرته أو محاولة استخراج شفرته المصدرية، أو استخدامه للوصول إلى خوادمنا بطريقة غير التي صُمم لها.
4. ما يُسمح لك به في المحتوى
- تصفح النوتات والتابات والمصادر لاستخدامك الشخصي غير التجاري: التدرّب والدراسة والتدريس داخل الفصل.
- مشاركة روابط النوتات مع الآخرين من زر المشاركة.
5. ما لا يُسمح به
- إعادة رفع النوتات أو نشرها على موقع أو تطبيق أو قناة أخرى، أو بيعها، أو استخدامها لأي غرض تجاري، دون إذن مكتوب منا.
- حذف اسم المدوّن أو اسم زرياب من النوتات.
- تنزيل المحتوى بشكل آلي أو بالجملة، أو استخدامه لبناء مكتبة أو خدمة منافسة.
- أي محاولة لاختراق التطبيق أو خوادمنا أو تعطيلها أو إثقالها.
6. الملكية الفكرية
النوتات والتابات المنشورة ملك لمدوّنيها، وينشرها زرياب بإذنهم. أما الألحان والكلمات الأصلية فهي ملك لأصحاب حقوقها. اسم زرياب وشعاره والتطبيق وتصميمه ملك لـ Madian Bros. لا تمنحك هذه الشروط أي حق في هذا المحتوى إلا ما ذُكر في البندين 3 و4. وإذا أرسلت إلينا تدويناً من عملك لنشره، تنطبق عليه أحكام البند 6 من شروط الموقع.
7. الشكاوى المتعلقة بحقوق النشر
إذا رأيت أن محتوى في زرياب ينتهك حقوقك، راسلنا على support@zeryapp.com واذكر: العمل المحمي، واسم النوتة أو رابطها، وما يثبت أنك صاحب الحق أو مفوّض عنه، ووسيلة للتواصل معك. سنراجع الشكوى ونزيل المحتوى أو نوقفه سريعاً إذا ثبتت.
8. محتوى الجهات الأخرى
يفتح التطبيق فيديوهات YouTube والنوتات التفاعلية على Soundslice والمقاطع الصوتية على Google Drive والمقالات داخل متصفح مدمج، ويفتح «إبلاغ عن خطأ» و«تواصل معنا» محادثة في Facebook Messenger. هذه الخدمات لها شروطها الخاصة، ولسنا مسؤولين عن محتواها أو عن توفرها.
9. متاجر التطبيقات
تنزّل التطبيق من Google Play أو Huawei AppGallery، وتنطبق أيضاً شروط المتجر الذي نزّلته منه. هذه الشروط بينك وبيننا فقط؛ Google و Huawei ليستا طرفاً فيها ولا تتحملان مسؤولية التطبيق أو محتواه أو دعمه.
10. إخلاء المسؤولية
نقدّم التطبيق ومحتواه «كما هو» و«حسب توفره»، دون أي ضمان. نبذل جهدنا لتكون النوتات دقيقة، لكنها قد تحتوي على أخطاء، ولا نضمن أن يعمل التطبيق دون انقطاع أو أخطاء أو على كل الأجهزة.
11. حدود المسؤولية
إلى أقصى حد يسمح به القانون، لا يتحمّل زرياب ولا Madian Bros أي مسؤولية عن أي ضرر مباشر أو غير مباشر ينتج عن استخدام التطبيق أو عدم القدرة على استخدامه أو عن الاعتماد على محتواه. لا يحدّ هذا البند من أي مسؤولية لا يجوز قانوناً تحديدها أو استبعادها، ولا من الحقوق التي يمنحك إياها قانون حماية المستهلك في بلدك ولا يجوز التنازل عنها.
12. إنهاء الاستخدام
يمكنك التوقف عن استخدام التطبيق في أي وقت بحذفه. ويجوز لنا منع الوصول إلى خدمتنا لمن يخالف هذه الشروط.
13. القانون الواجب التطبيق وحل النزاعات
تخضع هذه الشروط لقوانين جمهورية مصر العربية، وتختص محاكم القاهرة بنظر أي نزاع ينشأ عنها. ويحتفظ المستخدمون المقيمون خارج مصر بالحماية التي تمنحها لهم قوانين بلدهم الإلزامية.
14. التعديلات على هذه الشروط
قد نعدّل هذه الشروط، ويظهر تاريخ آخر تحديث أعلى الصفحة. إذا كان التعديل مهماً تظهر شاشة البداية من جديد لتوافق عليه، واستمرارك في استخدام التطبيق بعد ذلك يعني موافقتك على الشروط المعدّلة.
15. أحكام عامة
إذا تبيّن أن أي بند من هذه الشروط غير صالح، تظل بقية البنود سارية. هذه الشروط مع سياسة خصوصية التطبيق هي الاتفاق الكامل بينك وبيننا بشأن التطبيق. النص العربي هو النص المعتمد، والنص الإنجليزي أدناه ترجمة له.

1. Who we are and accepting these terms
The Zeryapp app is run by Madian Bros in Egypt. On first launch the app shows these terms and the app privacy policy; by tapping "I agree" you accept both. If you do not agree, please do not use the app and uninstall it. The website zeryapp.com has its own website terms.
2. The service
The app offers sheet music, guitar tabs and music-learning resources for free. We may add, change or remove content, and change, pause or stop the app at any time, without notice and without any obligation to you. We may require you to update the app to keep using it.
3. Licence to use the app
We give you a personal, free, non-exclusive, revocable licence to use the app on your devices. The app is licensed to you, not sold. You may not copy, modify, decompile or try to extract the app's source code, or use it to reach our servers in ways it was not designed for.
4. What you may do with the content
- View scores, tabs and resources for your own non-commercial use: practice, study and teaching in class.
- Share links to scores with the share button.
5. What you may not do
- Re-upload or republish scores on another site, app or channel, sell them, or use them commercially, without our written permission.
- Remove the transcriber's name or Zeryapp's name from a score.
- Download content automatically or in bulk, or use it to build a competing library or service.
- Try to break into, disrupt or overload the app or our servers.
6. Intellectual property
The published scores and tabs belong to their transcribers, and Zeryapp publishes them with their permission. The original melodies and lyrics belong to their rights holders. The Zeryapp name, logo, the app and its design belong to Madian Bros. These terms give you no rights in this content beyond sections 3 and 4. If you send us a transcription of your own for publication, section 6 of the website terms applies.
7. Copyright complaints
If you believe content on Zeryapp infringes your rights, write to support@zeryapp.com with: the protected work, the score's name or link, proof that you own the right or act for the owner, and how to reach you. We review complaints and promptly remove or disable content when a complaint holds.
8. Third-party content
The app opens YouTube videos, Soundslice interactive scores, Google Drive audio and articles in an in-app browser, and "Report a problem" and "Contact Us" open a Facebook Messenger chat. These services have their own terms, and we are not responsible for their content or availability.
9. App stores
You download the app from Google Play or Huawei AppGallery, and the terms of that store also apply. These terms are between you and us only; Google and Huawei are not parties to them and are not responsible for the app, its content or its support.
10. Disclaimer
The app and its content are provided "as is" and "as available", without any warranty. We try to make scores accurate, but they may contain errors, and we do not promise the app will run without interruption or errors, or on every device.
11. Limitation of liability
To the fullest extent the law allows, neither Zeryapp nor Madian Bros is liable for any direct or indirect damage arising from using or being unable to use the app, or from relying on its content. This does not limit any liability that the law does not allow to be limited or excluded, nor consumer rights in your country that cannot be waived.
12. Ending use
You may stop using the app at any time by uninstalling it. We may block access to our service for anyone who breaks these terms.
13. Governing law and disputes
These terms are governed by the laws of the Arab Republic of Egypt, and the courts of Cairo have jurisdiction over any dispute arising from them. Users living outside Egypt keep the protection their own country's mandatory laws give them.
14. Changes to these terms
We may change these terms; the date at the top shows the last update. If a change matters, the start screen shows again so you can agree to it, and continuing to use the app afterwards means you accept the changed terms.
15. General
If any part of these terms is found invalid, the rest remains in force. These terms and the app privacy policy are the whole agreement between you and us about the app. The Arabic text is the binding version; this English text is a translation.
